My Ban Apeal for the murder case!
New trial in SF murder case
A San Francisco man is entitled to a new murder trial for a 2007 shooting after state courts ruled that the prosecutor made an unsubstantiated claim to the jury that the sole eyewitness had risked her life by coming forward.
Jamal Trulove was convicted of murder for the fatal shooting of his friend, 28-year-old Seu Kuka, in the Sunnydale public housing complex in July 2007.
Trulove was identified as the killer by a neighbor, who said she saw him chase down Kuka and shoot him in the back after a late-night argument. Her identification was tentative at first, but she affirmed it after seeing Trulove three months later as a guest on the reality TV show “I Love New York 2.” Trulove said he was innocent.
In final arguments at his trial, the prosecutor said the eyewitness had been terrified at the psospect of testifying in a courtroom filled with Trulove’s friends and relatives, but was willing to “risk her life” to tell the truth. The prosecutor said her office had ordered the woman to enter a witness-protection program, and urged jurors to have “the same courage” as the witness and convict Trulove.
But the state’s First District Court of Appeal said the witness had entered the protection program voluntarily, and there was no evidence that any of Trulove’s friends or family had threatened her.
The prosecutor’s arguments, which drew no objection from Trulove’s trial lawyer, “implied a consciousness of guilt” and may well have influenced the verdict, Presiding Justice J. Anthony Kline said in a 3-0 ruling in January that overturned the murder conviction.
On Wednesday, the state Supreme Court unanimously denied review of an appeal by the prosecution.
Trulove’s appellate lawyer, Marc Zilversmit, said he’s prepared to call witnesses to attest to his client’s innocence if the district attorney’s office retries him. “We’re looking forward to an opportunity to clear Jamal’s name,” Zilversmit said.

He was but he can still participate in the forums.
Even though he was permabanned there is no reason that he can't be here unless he abuses forum rules and I doubt that this 'ban appeal that is not an appeal for a no apeal ban' would change anything.

I'd like to add something since it was I that banned both you and your buddy merdauk.
I'm usually lenient on ban appeals.
This is an expectation.
You took advantage of our kindness, you and merdauk both. And judging from the lovely xray tunnels I found under your island homes after I banned both of you for flying in front of my face (TP'd to you after comments involving a rape reference), you've took for granted our kindness again, and again, and again. There where tons of diamonds, and nearly a stack of raw diamond ore across the storage rooms. You knew what you where doing, and tried to pull wool over our eyes. Be lucky you got away with it as long as you did.
You both xrayed, you both fly hacked in front of me right after being unbanned and demoted.
To top it off, you both logged on to troll about rape and bellydancing.
I'll let you two appeal when hell freezes over. Any more threads like this? Consider yourselves forum banned. There is no third chance for either of you.
